Terms of Service

1. What Place Is

Place is a publishing platform that lets you create a personal profile page (place.so/[username]), publish content, and share interactive experiences. Some features of the Service use artificial intelligence to help you create, format, or enhance content.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian. By using the Service, you represent that you meet these requirements.

3. Your Account

• You are responsible for your account and for keeping your credentials secure.
• You must provide accurate information when creating your account.
• Usernames are provided on a first-come, first-served basis. We reserve the right to reclaim usernames that are inactive, infringe third-party rights (including trademarks), or impersonate others.
• You may not sell or transfer your account or username without our written consent.

4. Your Content

You own your content.Anything you create, upload, or publish on Place (“User Content”) remains yours.

By publishing User Content on the Service, you grant Place a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, and adapt (for technical purposes such as formatting and resizing) your User Content, solely as needed to operate, promote, and improve the Service. This license ends when you delete your content or your account, except (a) where your content has been shared with others and they have not deleted it, and (b) for reasonable backup and legal-retention periods.

You represent that you have all rights necessary to publish your User Content and that it does not infringe the rights of any third party.

5. AI Features

The Service includes AI-powered features that may generate or modify content based on your input. You understand that:

• AI-generated output may be inaccurate, incomplete, or similar to output generated for other users.
• You are responsible for reviewing AI-assisted content before publishing it.
• You retain responsibility for all content published under your account, whether created manually or with AI assistance.

6. Acceptable Use

You agree not to use the Service to:

• Publish content that is illegal, defamatory, harassing, hateful, or that exploits or endangers minors;
• Infringe intellectual property rights or misappropriate confidential information;
• Impersonate any person or entity, or misrepresent your affiliation;
• Distribute spam, malware, or engage in phishing or fraud;
• Scrape, harvest, or collect data from the Service in an automated manner without our written consent;
• Interfere with or disrupt the Service, servers, or networks;
• Circumvent any access or usage restrictions.

There is no tolerance for objectionable content or abusive users on Place. Every profile, post, and comment can be reported from within the app, and you can block any account from its profile. We review reports of objectionable content within 24 hours, removing the content and ejecting the responsible user where warranted. We may remove content or suspend accounts that violate these Terms, at our sole discretion, with or without notice.

7. Intellectual Property of Place

The Service, including its design, software, branding, logos, and mascot characters, is owned by Place or its licensors and protected by intellectual property laws. Except for your User Content, nothing in these Terms grants you rights to use our intellectual property without written permission.

8. Copyright Complaints

If you believe content on the Service infringes your copyright, send a notice to legal@place.so including: (a) identification of the copyrighted work, (b) the URL of the allegedly infringing material, (c) your contact information, (d) a statement of good-faith belief that the use is unauthorized, and (e) a statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the owner. We may remove infringing content and terminate repeat infringers.

9. Third-Party Services and Links

The Service may contain links to or integrations with third-party services. We are not responsible for their content, policies, or practices.

10. Mobile Application (App Store Terms)

If you download the Place app through the Apple App Store, you acknowledge that: (a) these Terms are between you and Place, not Apple; (b) Apple has no obligation to provide maintenance or support for the app; (c) Apple is not responsible for addressing any claims relating to the app; and (d) Apple is a third-party beneficiary of these Terms and may enforce them against you.

11. Termination

You may delete your account at any time. We may suspend or terminate your access to the Service at any time if you violate these Terms, if required by law, or if we discontinue the Service. Sections 4 (license survival), 7, and 12–15 survive termination.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT CONTENT (INCLUDING AI-GENERATED CONTENT) WILL BE ACCURATE OR RELIABLE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLACE AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify and hold Place harmless from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your violation of these Terms or any third-party rights.

15. Governing Law and Disputes

These Terms are governed by the laws of Mexico. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts of Mexico City, Mexico, and you waive any other jurisdiction to which you may be entitled by reason of your present or future domicile.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
